Any property that is transferred to others according to the provisions of a person's will is probate property, subject to the validation and administrative procedures of the probate courts. Jointly held property and assets that pass to survivors, as well as insurance policies and accounts that specify beneficiaries, are excluded. Trusts are also nonprobate property.
If you believe a deceased person's will does not fairly distribute property and wish to file a will contest that challenges its admission to probate, you and your attorney must demonstrate that the will is not valid for reasons such as:
- The deceased person, or testator, lacked appropriate mental capacity to execute the will
- The testator was subjected to fraud, coercion or undue influence while creating the will
- The will contains significant ambiguities
- The will is a forgery or was not witnessed in accordance with all legal requirements
